Welcome to Péché Mignon.

These Terms and Conditions of Sale and Use (hereinafter the “Terms”) govern all contractual relationships between Sarah SRL (hereinafter “Péché Mignon” or the “Seller”) and any person accessing the website www.peche-mignon.com or placing an order (hereinafter the “Customer”).

Any use of the website or validation of an order implies full, unconditional and unreserved acceptance of these Terms.

These Terms define, in particular, the conditions of ordering, payment, delivery, liability, as well as the respective rights and obligations of the parties.

Péché Mignon reserves the right to amend these Terms at any time. The applicable Terms are those in force on the date the order is validated.

In the event of disagreement, the Customer is advised not to use the website or its services.

These Terms shall prevail over any other document, including any purchasing conditions of the Customer, unless expressly agreed in writing by Péché Mignon.

2. PURPOSE AND SCOPE

These Terms apply to all use of the website and all orders for products delivered within the European Union and internationally, including the United Kingdom.

3. PRODUCTS

Products are food items, often artisanal and perishable.

Variations in appearance, shape, colour or taste may occur and do not constitute defects.

Images are non-contractual.

Péché Mignon reserves the right to substitute unavailable products with equivalent items of comparable value.

4. ORDER AND CONTRACT FORMATION

Any order constitutes a binding offer to purchase.

The contract is formed only upon express confirmation after payment validation.

The Seller reserves the right to refuse, suspend or cancel any order in cases including:

• fraud or suspected fraud
• abusive use of claims or refund mechanisms
• prior dispute
• manifest pricing or stock error
• inaccurate or incomplete information

5. PRICES AND PAYMENT

Prices are indicated in euros (€), VAT included, excluding delivery costs.

Additional costs (transport, customs duties, local taxes) are the Customer’s sole responsibility.

Payment is due immediately.

The Seller may suspend or cancel any order in the event of payment issues.

Payment provider liability:
Transactions are processed by third-party providers. Péché Mignon shall not be liable for technical failures attributable to such providers.

6. DELIVERY

6.1 Delivery times
Delivery times are indicative and non-binding.

6.2 Transfer of risk
In accordance with consumer law, risk transfers when the Customer (or a designated third party) takes physical possession of the goods.

6.3 Proof of delivery
Delivery is deemed completed when the carrier provides proof (scan, signature, GPS confirmation or equivalent), which shall prevail unless proven otherwise.

6.4 Customer obligations
The Customer must provide accurate delivery details and collect the parcel promptly.

6.5 Failure to receive
If non-delivery is attributable to the Customer, no refund shall be due.

6.6 International deliveries
Customs duties and taxes are borne by the Customer.

If customs clearance is refused or charges unpaid, the parcel may be destroyed or returned without refund.

7. FOOD PRODUCTS AND LIABILITY

The Customer is responsible for proper storage.

The Seller shall not be liable for deterioration due to delay, climate or improper handling.

The Customer must check allergens prior to consumption.

8. RIGHT OF WITHDRAWAL

Perishable goods are excluded from withdrawal rights.

No returns or refunds except in case of proven non-conformity at delivery.

9. CLAIMS

Claims must be submitted within 48 hours with full evidence.

Abuse: abusive or fraudulent claims may result in refusal of future orders.

10. INTELLECTUAL PROPERTY

All content is protected.

11. LIABILITY

Liability is limited to the order amount.

No liability for indirect damages.

12. FORCE MAJEURE

Obligations are suspended in case of events beyond control.

13. PERSONAL DATA

Data is processed under GDPR. Privacy Policy prevails in case of conflict.

14. CONTRACTUAL HIERARCHY

15. GOVERNING LAW

Belgian law applies. Courts of the Seller’s jurisdiction apply, subject to mandatory consumer rights.
